These terms govern any booking, charter, enquiry or use of the website boatrentalinmarbella.com ("the Site") operated by Boat Rental Marbella ("we", "us"). By submitting an enquiry, accepting a quote, paying a deposit or stepping on board a chartered vessel you confirm that you have read, understood and accepted these terms.

1. About us

Boat Rental Marbella is an independent charter agency based in Marbella, Andalucía, Spain. We coordinate skippered yacht, catamaran, motorboat and jet-ski charters operating out of Puerto Banús, Marbella Marina (Puerto Deportivo Virgen del Carmen), Cabopino, Estepona and Sotogrande. Charters are operated by licensed Spanish skippers and partner companies holding the appropriate maritime and commercial licences.

2. Booking process

  1. You send us an enquiry via the website booking form, WhatsApp, email or Instagram/Facebook DM, including the date, group size and preferred boat or experience.
  2. We reply with availability and a written quote (typically within a few hours, often within minutes during European working hours).
  3. The booking is confirmed only when (a) we send a written confirmation and (b) the agreed deposit or full payment has been received.
  4. You receive the departure address, skipper contact, meeting time and a short briefing by WhatsApp at least 24 hours before the charter.

3. Prices, payment and what's included

Prices are quoted in Euros (€), include Spanish IVA (VAT, currently 21%) and — unless we explicitly state otherwise — include the licensed skipper, fuel for the standard coastal route, soft drinks and water, snorkel gear, paddleboard, towels and standard insurance.

The following are typically not included unless stated: catered lunch, premium drinks, water-toy fuel (e.g. jet-ski excursion outside the charter), berthing fees in third-party ports, gratuities, and any optional add-ons (DJ, photographer, decoration).

Payment options vary by operator — typically a 30–50% deposit by card, Stripe link, Revolut or SEPA bank transfer to confirm, with the balance due in cash or card on the day of the charter. Specific terms appear on the written quote.

4. Cancellation, modification and refund policy

Unless your written confirmation states otherwise, the standard cancellation terms are:

Date changes are free of charge if requested at least 72 hours before departure and subject to availability.

5. Weather policy

The skipper is the sole authority on whether the trip can run safely. If the forecast wind exceeds Force 4–5 (approx. 20+ knots), sea state is unsafe, or a port authority issues a navigation warning, the skipper will postpone the charter — typically the evening before, or by 08:00 on the morning of the trip. In that case you are offered either:

Light rain alone is not a cancellation reason on the Costa del Sol. If you cancel because of weather while the skipper still considers the trip safe, the standard cancellation policy in section 4 applies.

6. Safety, conduct and the skipper's authority

On board, the captain has full legal and operational authority over the vessel and its passengers under Spanish maritime law. The captain may, at their sole discretion and without refund:

All passengers must follow the captain's instructions and the on-board safety briefing. Children under 12 must wear a life jacket at all times when the boat is underway. Pets are accepted only when agreed in advance and must travel with a dog-safe life jacket supplied by the owner.

7. Behaviour, damage and cleaning

Drugs of any kind are strictly forbidden on board — the captain is legally obliged to return to port and notify the Guardia Civil. The customer is liable for any damage to the vessel, fittings, water toys or third-party property caused by the customer or their guests through negligence or wilful misconduct, including but not limited to broken glassware, stained upholstery, lost or damaged snorkel gear and excessive cleaning (e.g. vomit, food spillage requiring deep clean — typically charged at €150–€500).

8. Late arrival and overruns

The charter slot begins at the agreed departure time. If you arrive late, the charter still ends at the originally agreed return time and no extension or refund is owed. Extending the charter on the day is usually possible if the next slot is free — additional time is charged at 80–100% of the standard hourly rate and must be agreed with the skipper before the booked slot ends.

9. Insurance

Every chartered vessel carries the third-party hull and passenger insurance required by Spanish law. This does not cover personal items (phones, cameras, jewellery, sunglasses), pre-existing medical conditions, or losses caused by your own breach of safety instructions. We strongly recommend you take out your own travel insurance with cruise/charter cover, particularly for high-value bookings or group trips.

10. Photography and content

From time to time the skipper or a drone operator may take photos or short videos during the charter. By boarding you consent to non-identifying use of this material on our website and social channels (Instagram, Facebook, TikTok, YouTube). If you do not want to appear in any published material, tell the skipper before departure and we will exclude you. You may withdraw permission for previously published images by messaging us on WhatsApp at +358 400 406 194.

11. Liability

To the maximum extent permitted by Spanish law, our liability for any loss arising from your charter is limited to the total amount you paid for that charter. We are not liable for indirect or consequential losses (missed flights, accommodation costs, loss of enjoyment) caused by weather cancellations, force majeure (storms, government orders, strikes, pandemics, port closures), or third-party acts. Nothing in these terms excludes liability for death, personal injury caused by negligence, or any other liability that cannot be excluded under Spanish consumer law.

12. Affiliate disclosure

Some links on this Site point to third-party operators or booking platforms. When we list a third-party operator we may receive a commission if you book through us. This never affects the price you pay and we only feature operators we would book ourselves.

13. Intellectual property

All text, photos, videos and graphics on this Site are © Boat Rental Marbella or used under licence. You may share individual pages on social media and link to the Site freely. You may not republish, scrape, or use the content for AI model training without our written permission. Boat brand names (Astondoa, Azimut, Mangusta, Ferretti, etc.) belong to their respective manufacturers and are used only for descriptive reference.

14. Applicable law and jurisdiction

These terms are governed by Spanish law. Any dispute between us and a consumer customer will be heard by the courts of the customer's place of residence within the EU, or by the courts of Marbella (Málaga) for non-EU customers. Consumer customers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to these terms

We may update these terms from time to time — the "Last updated" date at the top reflects the current version. The terms that apply to your booking are the ones in force on the day we send the written confirmation.
